Hi all :

I just watched the incredibles 1. I loved the movie very much.
One of my favorite characters is Frozone, I just love his ice/powers.
But it seems to me that the iceman from the x-men movies has very similar powers.
Aren't their powers very similar ? Is not this illegal ?
If I create a new superhero, with different name and look, but similar powers,
is not this illegal ?

You can copyright can an interpretation of an idea but not the idea itself. So, this really depends on how close you are to copying somebody else's interpretation of the idea.

Generally speaking, it's okay to create your own 'ice-based' superhero as long as it's not an exact or near-exact clone of somebody else's.

But even there, you have some legal wiggle room. If the work is a parody of another work, you can copy it pretty closely. (For example, the endless parodies in Mad Magazine.) However, the intent must be satirical and you can probably safely do it once. If you parody the same thing over and over again, like as an on-going series, it could be considered infringement.

In the case of The Incredibles, both Frozone and Iceman are technically Disney properties anyway, so I don't think it matters much to them. (Well, nowadays anyway...I don't think they owned Marvel yet when the first Incredibles was released.)

I'm no expert, but it strikes me that when it comes to characters, they aren't only defined by the powers they have, but also by their morals, personality, background.

Just writing a story about a character who can fly, and is bulletproof wouldn't make it a copy of superman, if the character grew up in a very different environment, and had a very different moral code.

If a lawyer needs to be involved, it's probably not worth it, illegal or not. :devil:
